TERMS AND CONDITIONS GOVERNING THE USE OF THIS WEBSITE
Grace Fragrances has created quality, generic fragrances of well-loved signature scents. Grace Fragrances uses imported botanical oils in our fragrance range that are not tested on animals. The use of branded designer names is not intended to infringe on the designer's trademark or manufacturer's name but to only give the consumer an idea of or the similar scent of a fragrance and not to mislead anyone. Grace Fragrances do not purport to be the original fragrances and are an inspiration for generic scents.
By visiting the Grace Fragrances website or purchasing a product or service from us, you agree to be bound by the following terms and conditions. These terms of service apply to all visitors and users of the website. Please read these terms of service carefully before accessing or using our website. By accessing or using any part of this website and ordering any products, you agree to be bound by these terms of service which are available to clients within South African only for now. You are legally capable of entering into binding contracts, and you are at least 18 years old; you are resident in South Africa and you are accessing our site from South Africa.
Description of goods and services.
Grace Fragrances (Pty) Ltd is a business in the beauty and cosmetic industry that manufactures and supplies generic fragrances. All descriptions of products are subject to change at any time. We reserve the right to discontinue any product at any time.
A contract is formed between you and Grace Fragrances.
After placing an online order, you will receive an e-mail from Grace Fragrances acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to Grace to purchase one of our products. All orders are subject to acceptance, and we will confirm such acceptance by sending you an e-mail confirming the product has been dispatched. The contract between Grace Fragrances and yourself will only be formed when we send you the Dispatch Confirmation.
Law and Jurisdiction
Contracts for the purchasing of our products on our website, any dispute or claim arising out of these contracts or in connection with them or their subject matter will be governed by South African Law. Any dispute or claim arising out of these contracts or in connection with them, including non-contractual disputes or claims, will be subject to the non-exclusive jurisdiction of the courts of South Africa.
Delivery policy.
On successful receipt of your order payment and subject to availability, requests will be processed within 1-4 working days and delivery confirmed by way of a courier company, such as The Courier Guy, PUDO, Courier It, and Fastway. Delivery takes on average between 2-5 working days depending on area accessibility. and our set rates are clearly shown at checkout. We currently do not offer international shipping.
Export restriction.
The offering on this website is currently available to South African clients only. We currently do not offer international shipping.
Return and Refunds policy
The provision of goods and services by Grace Fragrances is subject to availability. Prices for our products are subject to change without notice. Certain products or services may be available exclusively online through our website. These products or services may have limited quantities and are subject to return or exchange only according to our return policy. In cases of unavailability, Grace Fragrances will notify you as soon as possible and refund the client in full within 30 days. Should you the customer have canceled the Contract between us within the seven-day cooling-off period, we will process the refund due to you as soon as possible within 30 days of the day you gave notice of cancellation. In this case, we will refund the price of the product in full, excluding any applicable delivery charges. However, you are responsible for the cost of returning the item to Grace Fragrances. We will refund any money received from you via checkout using the same method originally used by you to pay for your purchase.
Customer Privacy policy
Grace Fragrances shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). Payment options accepted
Payment may be made via Visa and MasterCard and all pricing includes VAT.
Card acquiring and security
Card transactions will be acquired for Grace Fragrances via PayGate (Pty) Ltd who is the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3), and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
Customer details separate from card details
Customer details will be stored by (Your Company) separately from card details which are entered by the client on PayGate's secure site. For more detail on PayGate refer to www.paygate.co.za.
Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
Responsibility
Grace Fragrances takes responsibility for all aspects relating to the transaction including the sale of goods and services sold on this website, customer service and support, dispute resolution, and delivery of goods.
Events out of our Control
We will not be liable or responsible for any failure to perform or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event). This includes any act, event, non-happening, omission, or accident beyond our reasonable control and includes in particular (without limitation) the following:
Strikes, lock-outs or other industrial action; civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; fire, explosion, storm, flood, earthquake, subsidence, epidemic or another natural disaster; the impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; the impossibility of the use of public or private telecommunications networks; and the acts, decrees, legislation, regulations or restrictions of any government.
Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
Country of domicile
This website is governed by the laws of South Africa and Grace Fragrances chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
Variation
Grace Fragrances may, in its sole discretion, change this agreement or any part thereof at any time without notice. We reserve the right to amend these terms and conditions at any time. All amendments to these terms and conditions will be posted online.
